The Defect Liability Period (DLP) is a crucial phase in Dubai’s real estate sector that ensures the quality and durability of newly constructed properties. It is a stipulated timeframe during which the developer remains responsible for rectifying defects in the property after handover to the buyer.

Legal Framework Governing DLP in Dubai

Dubai’s real estate laws, particularly Law No. 6 of 2019 on Jointly Owned Properties in Dubai, regulate the Defect Liability Period. According to this law:

  • Developers are responsible for repairing and rectifying any defects in the property’s structure for up to 10 years from the date of completion.
  • Any mechanical, electrical, and plumbing (MEP) defects must be repaired by the developer within one year of the handover date.

The Dubai Land Department (DLD) and the Real Estate Regulatory Agency (RERA) oversee compliance with these laws to ensure consumer protection.

Coverage of the Defect Liability Period

The DLP covers various aspects of the property, including:

  • Structural Defects: Cracks in walls, roofing issues, foundation problems, etc.
  • MEP Defects: Faulty wiring, plumbing leaks, air conditioning failures, etc.
  • Finishing Defects: Poor-quality paint, flooring issues, improper fittings, etc.

However, it does not cover defects arising from misuse or lack of maintenance by the homeowner.

How to Claim Repairs Under DLP

If a property owner identifies a defect during the DLP, the following steps should be taken:

  1. Notify the Developer: Submit a formal complaint detailing the issue.
  2. Developer’s Response: The developer must acknowledge and schedule necessary repairs.
  3. Escalation to RERA: If the developer fails to act, the owner can file a complaint with RERA to enforce compliance.

The DLP provides peace of mind to property buyers by ensuring that their investment is protected against construction defects. It also holds developers accountable for delivering quality projects and adhering to building standards.
