For years, the frustrating pattern at handover went like this. You collected your keys, noticed the defects, sent a list to customer service, and then waited. And waited. The developer had already been paid in full, and your leverage was a politely worded email.

That balance has shifted. Under RERA’s current escrow framework, a portion of every project’s value stays locked up for a full year after handover — money the developer cannot touch until post-handover obligations are met. What Actually Changed — The 5% Post-Handover Retention

Dubai’s escrow system has protected off-plan buyers since Law No. 8 of 2007, but historically the protection ended roughly where the buyer’s problems began: at handover. The retention mandate extends it.

Under the current RERA escrow rules, banks hold back 5% of the total collected project value in the escrow account for one full year after handover. Those funds are ring-fenced specifically so that defects emerging in the first year of occupancy get rectified rather than argued about.

The practical effect is incentive alignment. A developer with a meaningful sum sitting in escrow has a commercial reason to close out snags quickly. But — and this matters — the mechanism only works if defects are documented, dated and formally submitted. A retention pool does nothing for a buyer who noticed a leaking shower tray in month three and mentioned it verbally to a site foreman.

You Hold Two Separate Protections, Not One

Most buyers think they have “a one-year warranty.” They actually hold two different instruments, governed by two different sources of law. Understanding the difference determines what you can claim, and for how long.

The 12-Month Defects Liability Period

The 10-Year Structural Warranty

Separately, under Article 880 of Federal Law No. 5 of 1985, the contractor and supervising architect are jointly liable for ten years from delivery for total or partial collapse and for any defect threatening the building’s structural stability or safety. This decennial liability is statutory and cannot be signed away by a developer’s contract.

The two run in parallel. A hairline crack in a partition wall is a DLP matter. Differential settlement affecting a structural slab is not.

Your 12-Month Timeline Starts the Day You Take Keys

A workable sequence looks like this:

  1. Before signing the handover form — commission an independent snagging inspection. This is the strongest position you will ever be in.
  2. At the handover appointment — attend in person or send a notarised representative under a specific Power of Attorney if you are overseas.
  3. Within 24 hours — submit the formal snag list in writing to the developer’s customer service department, with acknowledgement of receipt.
  4. Months 1–3 — push for rectification and re-inspect completed works. Defects should be reported promptly after discovery to preserve your position.
  5. Month 9–10 — commission a second inspection before the DLP window closes. Systems that passed a dry test in month one behave differently after a Dubai summer.

Signing the handover form does not waive your rights under the DLP. But a contemporaneous, dated, photographic record puts you in a materially stronger position if the matter ever reaches RERA or the courts.

What a Snagging Report Needs to Contain to Carry Weight

A phone-camera list in a WhatsApp message is evidence of nothing in a formal dispute. A professional snagging report Dubai developers act on has specific characteristics:

Unresolved matters proceed to the Dubai Courts or the Rental Dispute Settlement Centre depending on the claim.
